Texas Department of Licensing & Regulation (TDLR) has released their revised
Licensed Breeders Penalties and Sanctions:

Only 136 dog and cat breeders are now licensed, with 15 of those dual
licensed with USDA. RPOA plans to have HB 1451 repealed and replaced next
legislative session – with your help!.

This “HSUS Puppy Mill Bill” was written to eliminate all dog and cat
breeding in Texas — not regulate it.

Note near the bottom of the Penalty List “UNLICENSED ACTIVITY” (defined with
huge penalty) as:
* “Acted, offered to act, or represented to be a dog or cat breeder without
holding a license 802.101 (a)”
This wording is in the statute.

UNLICENSED ACTIVITY: Carries a Class F Penalty of $3,000 to $5,000 and/or
revocation for 1st Violation. $5,000 and/or revocation for 2nd and 3rd
violations.

HSUS, Texas Humane Legislation Network, and ASPCA turned in over 400
breeders’ websites, instigating TDLR investigations a year ago. And the
harassment continues. One hobby cat breeder has moved out of state due to
TDLR harassment.
TDLR insisted on entering her residence without a warrant, when she didn’t
have more than 10 intact female cats nor sold more than 20 kittens. It was
a matter of principle with her. Her email didn’t satisfy them.
So now we’re seeing a TDLR letter being mailed to breeders and infers all
breeders must be licensed. It includes a form to fill out with personal
information and mail back to TDLR.
Any animal owner in Texas who is contacted by TDLR, please contact RPOA.

One dog breeder just emailed us (after reading the Penalty List) that he
can’t make the laws, regulations, economics, and math work. Primarily
expenses incurred to meet these regulations; such as having 24/7 employee
animal supervision, plus requirement of proof of animal husbandry training
for those employees. He says “We do this as a hobby. Requiring an employee
payroll means I would have to run it like a business with production
schedules and sales pushes to meet payroll, artificial insemination, etc.”
He continues: “WHEN DID RAISING ANIMALS FOR FUN BECOME A CRIME?” (Name
withheld for obvious reasons)

Our official TDLR notice reads: The Texas Commission of Licensing and
Regulation enforcement plan gives all license holders notice of the specific
ranges of penalties and license sanctions that apply to specific alleged
violations of the statutes and rules enforced by the Department. The enforcement plan
also presents the criteria that are considered by the Department’s
Enforcement staff in determining the amount of a proposed administrative
penalty or the magnitude of a proposed sanction.

We fled Texas last June-No way I was putting up with any excuse to enter my property because someone might say I am breeding animals-NO WAY!!! Hell, they already put us thru 3 days of sever warrant-less searches including exhuming an animal with NO WARRANT!!!

Maybe a chilling picture of a warrant-less search is just what s needed here: DandyLion was ripped out of his grave by a county backhoe and when the clock turned 5 and time to go they left, leaving his decaying body out of the grave in close proximity with the rest of the animals for a full 24 hours-The purpose, I imagine, part of their original plan for a “show and tell” with the raid; they invited the media to come join them in their raid. Guess a change of …ahhh, mind?!?…It certainly was not a change of heart-they are completely heartless…Well, you judge for yourself with the pictures of a warrant-less search…WARNING comes with viewing these pics of the ‘deceased roaring lion’ that Kozlowski, convicted felon, owner Wisconsin Big Cat Rescue, complained about all the way from Wisconsin…This is a wake up call like no other as to what they can do and takes YEARS to go to trial for the civil liberty abuse that we endured.

Seems to me anyone with animals should beware!!! Do not allow anyone to enter your property without a warrant!!!

It’s a warrant-less search leaving no rock unturned…Doesn’t matter what kind of animals you have…Penal Code 42.092 is for non-livestock and Penal Code 42.09 for livestock…even if the Penal Code is missing on the warrant, they take your animals…even when TX-H&S Code 821.022 is missing (allowing for the taking of your animals) -Take “ALL animals, alive dead and unborn” while general, (general warrants are completely illegal) They take what they want including “other property”

Don’t think it can happen-think again-It already has in Marion County, Texas where they come and take animals even without a warrant (warrant-less search), no due process what so ever and then the gall to issue a warrant for the owner’s arrest-WTF!?!

  1. Please bear in mind, if law enforcement did this and the judicial system did what they did; what is the Texas Department of licensing and regulation going to attempt to get away with when already demonstrating their intent-Is this really what the legislature intended?!? Bet not!!!
