Message from TX-RPOA Gov vetos SB 346

Today is the last day for our Texas Legislature to conduct business!
However Governor Rick Perry could call a Special Session, which would extend
the pain for another month. We’ll have a full report on the twenty bills we
monitored over the past six months asap. It was a good session for animal
owners. Thanks to all of you and our lobbyist former Speaker Gib Lewis!

One bill flying under our radar until the last minute was Texas SB 346,
sponsored by Reps. Seliger, Geren, et al, relating to reporting requirements
of certain persons who do not meet the definition of a political committee
(PACs). Meaning IRS 501 (C) (4) Nonprofit Organizations! RPOA Texas
Outreach would have been affected by the bill and opposed it.

This legislation was an attack on freedom of speech comparable to the
national IRS scandal regarding IRS 501 (C) (4) Nonprofit Organization
applications. It was disturbing to watch this unconstitutional bill sail
through the legislative process on greased skids. Rumor was the sponsor had
a special target group in mind.

Hats off to Governor Rick Perry for his first veto of the Session for SB 346
with these comments:

“Freedom of association and freedom of speech are two of our most
importantrights enshrined in the Constitution. My fear is that SB 346 would
have a chilling effect on both of those rights in our democratic political
process. While regulation is necessary in the administration of Texas
political finance laws, no regulation is tolerable that puts anyone’s
participation at risk or that can be used by any government, organization or
individual to intimidate those who choose to participate in our process
through financial means.
At a time when our federal government is assaulting the rights of Americans
by using the tools of government to squelch dissent it is unconscionable to
expose more Texans to the risk of such harassment, regardless of political,
organizational or party affiliation. I therefore veto SB 346.”

RPOA is a nonpartisan Texas animal “welfare” organization
