The argument heats up…Ohio SB310 is more than some people can handle and fight for their right to own their animals without such restrictions being unattainable and virtually impossible!!! According to the Bill of Rights…SB310 is UN-Constitutional!!!

If Sen. Troy Balderson wants to be taken seriously and elected, since he was appointed, he needs to worry about the issues that benefit his constituents. He needs to stop wasting taxpayers’ time and money on the exotic animal bill that does not benefit the community in the real world and hurts small private exotic animal businesses.

In the past 22 years, only five people died in Ohio because of all captive exotic and wild animals. That’s 0.227 people per year: one by liger in 1992, two by venomous snakes in 2003 and 2004, one by python in 2006 and one by bear in 2010 (www.rexano.org/StatePages/Ohio_Exotic_ Death2011.pdf).

All fatalities happened to the owners, friends and handlers who voluntarily accepted the potential, small, hobby/occupational risk associated with keeping and handling wild and exotic animals. No uninvolved member of the public was killed by captive exotics in Ohio at least since 1990. Captive keeping of exotics is not a public safety issue.

The total number of Ohio resident deaths in 2008 by all causes was 109,750.

Ohio’s proposed exotic ban will be a waste of taxpayers’ money. There is nothing in the bill preventing an employee or volunteer from an (illegally) exempt facility accredited by private clubs to open the cages and intentionally release the animals the same way Terry Thompson released his. It was not caging that failed in Zanesville; it was intentional release. Ohio residents have a better chance of winning Mega Millions: 1 in 175,711,536 (ohiolottery.com), than being killed by captive big cat, bear or nonvenomous snake at 1 in 256,554,466 per each taxon.

The proposed bill needs to be killed.

Opposition to SB 310 Testimony

Chairman Hite, Vice-chairman Schaffer, Ranking member Gentile and members of the Senate Agriculture and Natural Resources Committee:

On three different occasions we have informed you of the violation of SB 310; how it violates 4 of the 20 Bill of Rights in the Ohio Constitution; how it takes the Rights of Citizens away and creates Privileges; how the fees and forced licensure is extortion; how it creates a monopoly for the Zoos on the Animal Kingdom; and how it will not solve the inherent risks or dangers on the public that could result in our everyday lives.

That being said, you and your Committee are now committing an act of infidelity upon the Citizens of Ohio, abusing your duty of office to PROTECT THE PEOPLE, and if SB 310 is enacted after your serious consideration, you will leave me no choice but to file a formal complaint to your bonding agency Zurich at 600 Red Brook Boulevard Suite 600, Owings Mills, Maryland 21117 as required under ORC’s 3.07, 3.22, 3.23, 3.30, 3.31,3.32,3.33.

I have also contacted the OBM, Debt Management Division, 30 E. Broad Street, 34th Floor, Columbus, Oh 43215 (obm.ohio.gov) and further action will be taken to Traci Brodie, Risk Management Supervisor Office of Risk Management, 4200 Surface Rd. Columbus, Ohio 43228
